If you believe a Platinum VPS customer is infringing upon your exclusive copyright…

When you have a good faith belief that the content on a system or network controlled or operated by Platinum VPS is infringing upon your exclusive copyright please take the following steps:

1. Provide written notification to Platinum VPS  on following e-mail address :

E-mail: abuse@platinumvps.com

Platinum VPS will:

» respond to your notification to assure we have received your notification;
» send the written notification to relavant client including a copy of your notification, asking for removing of the allegedly infringing content and requiring evidence of the removal be delivered to Platinum VPS within 24 hours;
» disable accessibility for the allegedly infringing material or even the client’s account in case the client fails to remove the allegedly infringing content and/or fails to inform Platinum VPS for the removal during 24 hours of Platinum VPS’s notification;
» send you notice of the client’s counter notification together with our intention to re-enable accessibility to the content or the account within 10-14 days of Platinum VPS’s receipt of any customer counter notification. (This paragraph applies on condition that the counter notification satisfies the requirements shown below.)

2. If Platinum VPS sends you notice of the client’s counter notification, please send notice to Platinum VPS that you have filed an action seeking a court order to restrain the client from engaging in the infringing activity.

Platinum VPS will, upon receipt of your notice of filing an action:

» notify to the client on your notice of submitting an action seeking a court order and also the accessibility of the account or content will remain disabled; and
» avoid re-enabling the client’s accessibility for account or information.

ALLEGED COPYRIGHT INFRINGEMENT NOTIFICATION REQUIREMENTS

Please include all of the following information in your written notification to Platinum VPS:

» A physical or electronic signature of authorized person;
» Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are addressed by a single notification, a representative list of such works at that site;
» Identification of the content which is said to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and details fairly adequate making it possible for Platinum VPS to locate the content;
» Information quite adequate to let Platinum VPS to contact the complaining party, such as an address, contact number, plus, if available, an electronic mail address by which the complaining party should be contacted;
» A statement that the complaining party has a good faith belief that use of the content in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
» A statement that the details in the notification is legitimate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right which is allegedly infringed.

If you receive a Notice of Alleged Copyright Infringement…

Platinum VPS has received a notice that Platinum VPS’s network, system(s), or shared server space allotted to your account consist of content which is claimed to be infringing upon the exclusive copyright of the sender of that notice. According to the Digital Millennium Copyright Act, 17 United States Code § 512, Platinum VPS required to response expeditiously to remove the content which is claimed to be infringing.

Platinum VPS requests that, within 24 hours of receiving Platinum VPS’s Notice of Alleged Copyright Infringement, you remove the allegedly infringing content and notify Platinum VPS that you have done so.

If you fail to remove the content and notify Platinum VPS that you have done so, Platinum VPS will eliminate accessibility of the content or disable the access of your account.

However…

if you believe in good faith that the allegedly infringing content that has been removed or to which access has been disabled was done so by mistake or misidentification, please take the following steps:

1. Provide a written notification, called a counter notification, to Platinum VPS as soon as possible.

The counter notification must meet the requirements listed below.

Platinum VPS will:

» respond to your notification to assure we have received your notification;
» send the complainant written notification of your counter notification and inform them that access of the content will be enabled within 10-14 days of Platinum VPS’s receipt of your counter notification unless the complainant provides written notification to Platinum VPS that it has filed an action in the court to keep back accessibility of the allegedly infringing content;
» enable accessibility of the allegedly infringing content or your account within 10-14 days of Platinum VPS’s receipt of your counter notification except the complainant provides written notification to Platinum VPS that it has filed an action in court to restrain accessibility to the allegedly infringing content;

COUNTER NOTIFICATION – REQUIREMENTS

Your written counter notification to Platinum VPS must include all of the following information:

» Identification of the content that has been removed or which access has been disabled and the location of the material before its removal or denial or access;
» A statement that, under penalty of perjury, you have a good faith belief that the content removed or to which access has been disabled was done so by mistake or misidentification;
» Your name, address, contact number; and
» A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the US, for any judicial district in which Platinum VPS may be found and you will accept service of process from the person, or their agent, who provided notification who is complaining of the alleged infringement.
